VA Stormwater Management Program (VSMP)
As a VSMP Authority, Loudoun County issues and administers permits for regulated land disturbing activities to ensure compliance with the regulations both during and after construction.
VSMP Application Package (for projects other than Single-Family Detached Residences)
The VSMP application package is typically submitted as a companion to a Land Development Application (LDA) (i.e., one that will result in land disturbance, such as a Site Plan or Construction Plans and Profiles) or a Grading Permit application.
Required Documentation
The following documents are required for a VSMP application:
- Stormwater Pollution Prevention Plan (SWPPP)
- View information about the required format of the SWPPP (PDF)
- The SWPP consists of multiple items, including:
- The Stormwater Management Plan and Erosion and Sediment Control Plan portions of the SWPPP are typically already submitted with a land development application (such as a site plan, grading plan, or construction plan and profiles).
- Requirements for Erosion & Sediment Control Plan: Chapter 1220 of the Codified Ordinances and Chapter 7 of the Facilities Standards Manual.
- Requirements for Stormwater Management Plan: Chapter 1096.01 of the Codified Ordinances and Chapter 5 of the Facilities Standards Manual.
- The Pollution Prevention Plan (P2 Plan), which addresses control of construction-phase pollutants, such as trash, concrete waste, fuel spills and portable toilets. The P2 Plan is not reviewed for approval.
- Completed Registration Statement (PDF) (including 8.5” x 11” site map)ens a New Window.
- Indicate the latitude and longitude of the project, the Hydrologic Unit Code(s) in which the project is located, and the name(s) of the receiving waters on the form.
- Completed Permit Fee Form (PDF)
Submit an Application
Submit your completed VSMP Permit Application Package with the required documentation outlined above online in PDF format.
Fees
After submitting, you will be contacted with your required fee amount prior to payment.
Fees are collected both by Loudoun County and the Virginia Department of Environmental Quality (DEQ). The applicant may choose to:
- Pay the total county VSMP fee at the time the VSMP application package is submitted,
or - Pay 50% of the county VSMP fee up front, with the remainder to be paid prior to permit issuance.
- Learn about payment options.
Once all Stormwater Management and Erosion and Sediment Control comments have been addressed and all fees have been paid, the county will send permit data to DEQ. DEQ will then contact the applicant regarding payment of the state fee.
VSMP Permitting Process Overview
VSMP Application Package for Single-Family Detached Residences
The following application requirements apply to construction of homes within a Common Plan of Development or Sale and to homes that are separately built, where the disturbed area per lot does not exceed 5 acres.
Required Documentation
The following documents are required for a VSMP application for single-family detached residences:
- Completed Loudoun County Single-family Detached VSMP Application (PDF)
- Completed Single-Family Residence Stormwater Pollution Prevention Plan (SWPPP) Template (PDF)
- Stormwater Management (SWM) Plan or Agreement in Lieu of a Stormwater Plan
- If within a Common Plan of Development, an overall stormwater management plan must be approved that governs development of each lot. The approved plan covers stormwater requirements for the lot.
- If not within a Common Plan of Development and disturbing less than 5 acres: applicants must submit a Completed Agreement in Lieu of a Stormwater Plan (PDF)
- Completed Permit Fee Form (PDF)
- For VSMP Permits for construction of homes within a Common Plan of Development or Sale and to homes that are separately built, where the disturbed area per lot does not exceed 5 acres: $405 per lot.
Common Plan of Development
A Common Plan of Development (CPoD) is defined as "a contiguous area where separate and distinct construction activities may be taking place at different times on different schedules." Lots recorded prior to July 1, 2004 are not considered to be part of a Common Plan of Development.

VSMP Authority
As of July 1, 2014, Loudoun County is established as a VA Stormwater Management Program (VSMP) Authority, as required by the Virginia Stormwater Management Act and the attendant regulations. The new regulations are adopted in Chapter 1096 of the Loudoun County Codified Ordinances and Chapter 5 of the Facilities Standards Manual (FSM). Permits
As a VSMP Authority, Loudoun County issues and administers permits for regulated land disturbing activities to ensure compliance with the regulations both during and after construction. The process includes plan review and approval, site inspections during and after construction, and operation and maintenance of the stormwater management system following construction. In addition, Loudoun County’s program is overseen by the Virginia Department of Environmental Quality (DEQ), which also issues permit coverage under the state’s VPDES Construction General Permit. This "dual coverage" by Loudoun County and the state must be obtained prior to land disturbance.
