Filing Claims

When a Claim Must Be Filed

A claim must be filed:

  • Within one year from the date of the crime in an injury case
  • Within one year from the date of victim's death if death is caused by the crime
  • Within one year after a minor reaches majority age

A victim of child sexual assault has 10 years past the date of their 18th birthday to file. A claim can be filed past the one year deadline if "good cause" can be shown (for crimes occurring after July 1, 2001). The Criminal Injuries Compensation Fund (CICF) encourages you to file a claim as soon as possible after the date of the crime. Please know that a delay in filing a claim may make it difficult to obtain information needed to pay a claim. CICF requires records that may not be available after certain time periods.
