DRUG CHARGE RETURNS LEESBURG MAN TO PRISON

JURY FIXES SENTENCE AT FOUR YEARS

LEESBURG, Virginia – October 14, 2014. A Loudoun County jury found David Anthony Frye, 28, guilty of possession of schedule I or II controlled substance and fixed his sentence at four years in the Virginia Department of Corrections.

During the evening hours of February 23, 2014, officers with the Leesburg Police Department observed Frye sitting in the passenger seat of a vehicle in the Days Inn parking lot. The officers attempted to make contact with Frye knowing that he had outstanding warrants for his arrest, and that the vehicle he was in had previously been reported stolen. Frye was unresponsive to the officers’ requests for him to exit his vehicle. Officers broke the window of the vehicle, extracted Frye, and placed him under arrest. Subsequent search of the vehicle and Frye’s belongings revealed a vial containing phencyclidine (PCP).

During the sentencing phase of the trial, Assistant Commonwealth’s Attorney Joshua P. Steward presented evidence of Frye’s extensive criminal history which included convictions for possession of a schedule I or II controlled substance, discharging a firearm within city limits, and trespassing.

“One of the more frustrating aspects of prosecution is the challenge of keeping repeat offenders such as this out of the community. Continued attempts by the court to rehabilitate and redirect behavior are ineffective for some, and we’re pleased this jury was able to consider the defendant’s history when fixing the sentence,” said Commonwealth’s Attorney Jim Plowman.

Frye is currently being held at the Loudoun County Adult Detention Center and awaits a final sentencing hearing on January 14, 2015 at 9:00 a.m., before the Hon. J. Howe Brown who presided over the trial.

Additionally, Frye has an upcoming hearing on October 20, 2014 for probation violations in the Loudoun County Circuit Court, where previously suspended time may be re-imposed.
