MANASSAS MAN SENTENCED FOR DUI MAIMING

AYALA TO SERVE TWO AND A HALF YEARS

LEESBURG, Virginia – April 7, 2015. Eynar Alsir Ayala, 22, appeared before the Circuit Court of Loudoun County, in custody, for sentencing on one count of driving while intoxicated and one count of maiming of another resulting from driving while intoxicated. Judge Burke F. McCahill imposed two and a half years in the Virginia Department of Corrections and a $500 fine

On October 8, 2012, Ayala was the driver of a vehicle that was involved in a single car accident. Ayala’s vehicle veered off the road and struck a fence line. The front seat passenger of the vehicle suffered a broken skull and traumatic brain injury as a result of the accident. Loudoun County Sheriff’s Office Deputies observed Ayala to be intoxicated at the scene of the accident. The Virginia Department of Forensic Science analyzed Ayala’s blood, and determined that his blood alcohol content was .16, twice the legal limit in Virginia.

Ayala pleaded guilty to the charges on December 8, 2014.

The victim and his family testified at the sentencing hearing on how this event has impacted their lives. The victim’s father testified how the challenges his family faces are compounded by the fact that this wasn’t just a one-time event. “It’s not like a broken leg that will heal in a couple of weeks, or a car that can be replaced. [My son] and our entire family has to live with this for the rest of our lives,” said the victim’s father.

Before imposing sentence Judge McCahill noted how this was “one of those cases that truly falls into the category of lose lose.” This was “tragic, senseless, and avoidable,” and “the amount of time that I impose upon you is not a reflection in any way of what the value of these injuries are, because if that was the case there is not enough time that I could impose,” continued McCahill.

Ayala received an additional three and a half years of suspended time and an additional $2,000 suspended fine. Upon his release, he will be placed on five years of supervised probation, followed by five years of unsupervised probation. McCahill ordered Ayala to pay $52,297.03 in restitution towards the victim’s medical expenses and other assorted costs related to the incident. Ayala’s operator’s license is permanently revoked.
