[ARCHIVED] Derrius Guice Case Dismissed

The Loudoun County Commonwealth’s Attorney’s Office announced that on June 23, 2021, the Commonwealth v. Derrius Guice case was dismissed pursuant to the entry of an accord and satisfaction agreement. Mr. Guice was charged with offenses of assault and battery and destruction of property. This agreement was presented to the court by the victim and Mr. Guice pursuant to Virginia Code Section 19.2-151.

This code section empowers the victim to request that the criminal case be dismissed after the accused has performed certain acts that render the victim satisfied. A judge may dismiss certain offenses at the request of the victim who acknowledges in writing that she has received satisfaction for the injury. This process permits the parties to control the direction and outcome of such matters. In this case, the victim and Mr. Guice appeared in court and requested that the court accept the agreement and dismiss the prosecution.

After consideration of the representations made by the victim, the court dismissed the matters against Mr. Guice. The case was prosecuted by Chief Deputy Commonwealth’s Attorney Shaniqua Clark Nelson and Assistant Commonwealth’s Attorney Kimberly Phillips.
