FOURTH PROBATION VIOLATION RETURNS VIOLENT REPEAT OFFENDER TO PRISON FOR ANOTHER 6 YEARS
JUDGE RE-IMPOSES BALANCE OF PREVIOUSLY SUSPENDED TIME
LEESBURG, Virginia – August 23, 2013. John Berkley Holland, 50, appeared before Judge Thomas D. Horne in Loudoun County Circuit Court for a hearing after being charged with violating his probation.
Holland’s probation stemmed from an August 1999 incident where he was charged with Aggravated Sexual Battery. The victim in that case was a 12 year old boy.
Holland pleaded guilty to Attempted Aggravated Sexual Battery in April 2000. Holland was sentenced on August 4, 2000, to a total active sentence of two years in the Virginia Department of Corrections with an additional eight years of suspended time.
Upon his release from incarceration, Holland was placed on supervised probation.
Since his release from prison, Holland has violated his probation four times for incurring new criminal convictions, failing to report to probation, failing to report his current address, having prohibited contact with children, and most recently for having been convicted of failing to re-register as a violent sex offender in Winchester, Virginia Circuit Court.
Judge Horne found Holland in violation of his probation and re-imposed the balance of Holland’s previously suspended time, totaling six years. “Seldom are offenders afforded multiple opportunities to redirect their behavior,” said Commonwealth’s Attorney Jim Plowman. “At some point the Court must decide that the limited resources of Probation Officers are better used on those willing to change their lives, which was the case here.”
Pursuant to Virginia’s Sex Offender and Crimes Against Minors Registry Act, Holland will also be required to continue to re-register as a violent sex offender upon his release.
