REPEAT DRUNK DRIVER HEADED TO PRISON

JUDGE IMPOSES TWO YEAR PRISON TERM

LEESBURG, Virginia – April 24, 2015. Jose Tomas Aguilar-Aguilar, 34, appeared before the Circuit Court of Loudoun County and was sentenced for a January 2015 incident.

In the late evening hours of January 23, 2015, an officer with the Leesburg Police Department conducted a traffic stop on a vehicle after observing the vehicle swerve across the roadway and then come to a complete stop in the middle of the road with its left turn signal on. The driver of the vehicle was identified as Aguilar-Aguilar. Upon speaking with Aguilar-Aguilar, the officer observed him to have blood shot eyes and there was a strong smell of alcohol emanating from the vehicle. Aguilar-Aguilar failed to successfully complete the field sobriety tests administered by the officer and he was arrested for driving while under the influence, 3rd or subsequent offense within 10 years.

Aguilar-Aguilar was transported to the Loudoun County Adult Detention Center where he provided a sample of his breath which was analyzed and found to have a blood alcohol level of .19, over twice the limit required to be under the influence while driving.

Aguilar-Aguilar pleaded guilty to one count of the felony of driving while under the influence of alcohol, 3rd or subsequent offense on March 19, 2015.

Aguilar-Aguilar has two prior convictions for driving under the influence in West Virginia, and two prior convictions for driving under the influence in Virginia.

Circuit Court Judge Jeanette A. Irby sentenced Aguilar-Aguilar to two years in the Virginia Department of Corrections. Irby imposed an additional three years of suspended time, and ordered Aguilar-Aguilar to be placed on five years of supervised probation upon his release.
Aguilar-Aguilar’s privilege to operate a motor vehicle is revoked.
