Indecent Liberties by a Custodian Sends Loudoun Restaurateur to Prison for Fourteen Months

LEESBURG, Virginia – July 11, 2016. Leopoldo Jacobo Lugo, 59, appeared before Judge Douglas L. Fleming, Jr., in Loudoun County Circuit Court for sentencing on one count of indecent liberties with a child by custodian.

Lugo was charged after it was revealed that he had sexually abused a minor child over a course of several years, with at least one incident occurring while Lugo and the victim were living in Loudoun County. This information was disclosed by the victim after she was interviewed in response to a complaint made to the Virginia Department of Social Services.

Lugo pleaded guilty to the offense on March 29, 2016.

Sr. Assistant Commonwealth’s Attorney Gigi Lawless, urged the Court to impose a sentence greater than the recommendation of the Virginia Sentencing Guidelines, which called for probation. “The defendant’s behavior is repulsive and disgusting and we as a society simply cannot tolerate it,” said Lawless. Lawless went on to further the Commonwealth’s position by reiterating that Lugo’s sole purpose to commit this offense was for nothing more than to gratify his own sexual desires.

Before imposing a sentence, Fleming addressed Lugo directly, “You have one role as a parent and that is to protect your child, and you sir failed.” Fleming imposed a total active sentence of fourteen months in the Virginia Department of Corrections.

Fleming imposed an additional three years and eight months of suspended time. Upon his release, Lugo will be placed on five years of supervised probation.

Pursuant to Virginia’s Sex Offender and Crimes Against Minors Registry Act, Lugo will also be required to register as a sex offender.
