Career Drug Dealer Sentenced to Seven Years in Prison

CAREER DRUG DEALER SENTENCED TO SEVEN YEARS IN PRISON

CRIMINAL HISTORY DATES BACK OVER 30 YEARS

LEESBURG, Virginia – July 22, 2016. A fifty-eight year old Ashburn man appeared before the Loudoun County Circuit Court for sentencing on one count of possession with intent to distribute a schedule I or II controlled substance and one count of distribution of a schedule I or II controlled substance. The Hon. Judge Stephen E. Sincavage sentenced Gilberto Carlos McFarlane to seven years in the Virginia Department of Corrections.

In late October 2015, the Loudoun County Sheriff’s Office became aware of an individual distributing crack cocaine in Loudoun County. This individual was later identified as McFarlane. Detectives arranged for a confidential informant to purchase approximately $500 worth of crack cocaine from McFarlane. The transaction was captured on an audio recording device.

In December 2015, McFarlane was arrested after law enforcement observed him selling suspected narcotics. A search warrant executed on McFarlane’s Ashburn home, yielded a safe containing U.S. Currency, a digital scale, cell phone, and five bags of crack cocaine. The crack cocaine was sent to the Virginia Department of Forensic Science for analysis. Analysis revealed that the bags contained 72.16 grams of crack cocaine.

Based on the weight of the crack cocaine seized from McFarlane, it is estimated to have an approximate street value of $7,200.

McFarlane’s prior criminal history dates back to 1984 and includes three prior convictions for possession with intent to distribute a controlled substance, one prior conviction for possession with intent to distribute marijuana, and convictions for felony credit card fraud, a weapons charge involving a machine gun, and numerous other misdemeanor offenses.

Judge Sincavage also imposed an additional ten years of suspended penitentiary time. Upon his release from incarceration, McFarlane will be placed on five years of supervised probation.
