JURY FINDS MARYLAND MAN GUILTY IN ATTEMPTED ROBBERY
FIVE YEAR PRISON SENTENCE RECOMMENDED
LEESBURG, Virginia – September 28, 2012. A Loudoun County jury found Ademamola Oriade Adeniran, 22, guilty of attempted robbery and use of a firearm in the commission of a robbery. The jury fixed his punishment for the two felony charges at five years in prison.
The incident occurred in the early morning hours of July 30, 2011, when Adeniran and a co-defendant, Chinwe Enoch, entered a hotel room displaying both a knife and a gun in an attempt to rob a 27 year old woman. Enoch entered a plea of guilty to a felony earlier in the week for his role in the crime.
Deputy Commonwealth’s Attorney Stephen Sincavage, who prosecuted the case, asked the jury to “put a price on the defendant’s conduct,” pointing out that Adeniran “has been prosecuted before, has been to court before, and yet here he is again.” After careful consideration of the evidence, the jury held Adeniran accountable for his repeat violent behavior and directed that he serve five years in a Virginia penitentiary.
During the sentencing phase of the trial, the jury received evidence of the Adeniran’s prior criminal record which included a conviction in Loudoun County for misdemeanor obtaining money by false pretense and a misdemeanor fourth degree sex offense conviction in Maryland.
The case will be back in Circuit Court again on January 14, 2013 where a final sentencing hearing will be conducted before the Hon. Burke F. McCahill who presided over the trial. Under Virginia law a judge may reduce a jury sentence providing written reasons therefore, but may not increase a jury sentence. Three years of the five year sentence imposed is a mandatory minimum sentence as directed under the Virginia Code, and therefore cannot be reduced in whole or in part.
