Existing Conservation Easements
Land may be put under conservation easement through differing processes. For mapping purposes, each easement is classified as a Gift or Development easement.
Both Gift and Development easements are permanent agreements that are legally recorded as part of a property’s deed.
These have been donated or purchased by a qualified governmental or nonprofit conservation organization, such as the Loudoun County Board of Supervisors, Virginia Outdoors Foundation, or Land Trust of Virginia.
These also include easements from the Purchase of Development Rights (PDR) program, which ran from 2000-2004, as some portion of these were donated to the county or another qualifying organization and are typically eligible for federal or state tax benefits.
These are created as a part of the land development zoning process, such as a low density development or rural hamlet. These include Transfer of Development Rights (TDR) easements, as those existing in the county were established as part of the land development process.
Conservation easements are legally recorded as part of the deed on a property and assigned an instrument number. Using the interactive map Opens a New Window. , you can click any easement area to see the instrument number and other information specific to that easement.
Copies of the deed of easement can be obtained from the Clerk of the Circuit Court Land Records Division Opens a New Window. using the associated instrument or parcel number.
