2024 Reissuance of the VSMP Construction General Permit

The current 2019 Virginia Stormwater Management Program (VSMP) Construction General Permit will expire on June 30, 2024, and any operator who intends to continue coverage must submit a new registration statement at least 60 days prior to the expiration date, or no later than May 1, 2024. Under state and county regulations, construction activities that require VSMP permit coverage may not continue beyond June 30 until coverage under the 2024 permit is obtained.

Loudoun County’s administrative process for reissuing those permits for which it is the VSMP Authority will be as follows.

For existing issued permits:

  • Documents: The only document that is required to be submitted is the 2024 Registration Statement. The site map required in Section IIA of the form is not required for reissuance. The 2024 Registration Statement form and instructions are now available on the Virginia Department of Environmental Quality’s (DEQ) website at: 2024 VPDES Construction General Permit (DOC).
    • Note: Contact information may be updated on the Registration Statement; however, the Construction Activity Operator must remain the same as the current operator. The only way to change the permitted operator is through a permit transfer, which must be processed separately.
  • Process: Registration Statements for the reissuance must be submitted through the Loudoun County LandMARC system.
    • Log into the system.
    • Open each permit to be reissued.
    • Go to the “Sub-records” tab.
    • Find VSMP Renewal and click “Apply. “
  • Fees: There are no fees for the reissuance, but payment of annual maintenance fees must be up to date before a permit is reissued. Maintenance fees will be invoiced through LandMARC. 
  • Stoppage of Work: As noted above, per state and county code, construction activities that require VSMP permit coverage may not continue beyond June 30 until coverage under the 2024 permit is obtained. Because reissuance of the Construction General Permit is a state-wide process affecting thousands of permits, delays in processing through DEQ are anticipated, such that some new coverage letters may not be issued by July 1. However, operators who have in good faith submitted a complete and accurate Registration Statement and have paid all annual maintenance fees will be considered covered under the new 2024 permit and will not be required to stop work.
  • Permit Termination: If the project will be completed and final stabilization is achieved by June 30, 2024, a Notice of Termination (PDF) shall be submitted to terminate the permit. 

Permits that have not yet been issued:

For new permit applications—including those that will be submitted before June 30 and those that have already been submitted with the 2019 Registration Statement but have not yet been issued—the 2024 Registration Statement must be uploaded to LandMARC under the main VSMP permit application, and county staff will create the renewal application after the original permit application has been issued. 

Note: Operators who are not seeking coverage under the current 2019 permit (For example;  construction is not anticipated to start before July 1, 2024), may submit only the 2024 Registration Statement as part of a complete application package. In such cases, the intent should be clearly stated in the project description narrative in LandMARC.

Single-family detached permits:

VSMP permits issued by Loudoun County for single-family detached (SFD) construction, either separately built or within a Common Plan of Development, will be administratively renewed. Operators will not be required to submit any documents; however, a new 2024 SFD coverage letter and copy of the 2024 General Permit must be printed from DEQ’s website prior to July 1 and placed in the Stormwater Pollution Prevention Plan (SWPPP) book on-site.

Stormwater Pollution Prevention Plan Updates 

All permit holders, including SFD operators, must be sure to update the SWPPP as necessary to comply with the 2024 Construction General Permit regulation, effective July 1, 2024. These updated documents do not need to be submitted to Loudoun County but must be incorporated into the SWPPP on-site.
